This website www.lacorneitalienne.com and/or the services, including all connected mobile applications (collectively the "Services") and any offer or sale of products ("Products") via the Site, are owned and operated by the brand La Corne Italienne, property of the company Avenir Lafayette, a simplified joint-stock company registered with the Trade and Companies Register of Lyon under number RCS 919626580 (hereinafter also referred to as "we", "our" or "us"). These Commercial Terms ("Terms") set out the terms and conditions under which visitors or users (collectively, the "user" or "you") may visit or use the Site and/or the Services and purchase Products.

By accessing or using the Services, you acknowledge that you have read and agree to these Terms, and you agree to be bound by them. If you do not agree to all of the Terms, you may not access the Site or use any of the Services. Please read these Terms carefully before accessing or using our Site or Services, or purchasing Products. In these Terms, you will find out who we are, how we sell our Products to you, how you can terminate the purchase contract, and what you can do if there is a problem.

You declare that you are of legal age and possess the legal authority, right, and power to enter into a binding agreement based on these Terms, to use the Services, and to purchase Products. Product Description

1.     You must carefully read the description of the Services and/or Products before placing an order. The description of the Services and/or Products presents the essential characteristics of the Services and/or Products, in accordance with Article L. 111-1 of the Consumer Code. These descriptions are designed to provide you with the most complete information possible about these characteristics, without being exhaustive. Photographs, drawings, and descriptions of the Products and/or Services are provided for informational purposes only and are not binding on us.

2.      We invite you to refer to the information and instructions for use on the packaging, labels, and accompanying documents. We cannot be held responsible for damage resulting from non-compliance with these instructions for use of the Products and/or Services provided on our website.

Purchase of Products

(1) Any purchase of Products is subject to the Terms applicable at the time of such purchase.

(2) When purchasing a Product: (i) it is your responsibility to read the full list of items before committing to purchase them; and (ii) placing an order on the site (by completing the payment process by clicking the "Buy" button or a similar button) may lead to a legally binding contract for the purchase of the Product concerned, unless otherwise stated in these Terms.

(3) You can choose from our selection of Products and place the products you intend to purchase in a shopping cart by clicking the corresponding button. The prices we charge are indicated on the Site. We reserve the right to change our prices or correct any pricing errors that may inadvertently occur, at any time. These changes do not affect the price of Products you have already purchased previously. At the time of payment, a summary of all Products you have placed in your shopping cart will be presented to you. This summary includes the essential characteristics of each product as well as the total price of all products, the applicable Value Added Tax (VAT), and shipping costs, as applicable. The payment page also gives you the option to check and, if necessary, modify or remove Products, or change quantities. If necessary, you can also identify and correct input errors using the editing function before making your order definitively binding. Any indicated delivery time applies from the receipt of your payment of the purchase price. By pressing the "Buy" button, you place a firm order to purchase the advertised Products at the indicated price and with the indicated shipping costs. To complete the ordering process by clicking the "Buy" button, you must first accept these Terms as legally binding for your order by checking the corresponding box.

(4) We will then send you an email confirmation of receipt of your order, in which your order will be summarized again and which you can print or save using the corresponding function. Please note that this is an automatic message that merely documents the fact that we have received your order. It does not indicate that we accept your order.

(5) The legally binding contract for the purchase of products is concluded only when we send you an acceptance notice by email or deliver the Products to you. We reserve the right not to accept your order. This does not apply in cases where we offer a payment method for your order and you have chosen it, if a payment process is initiated immediately after the submission of your order (for example, an electronic money transfer, or an instant bank transfer via PayPal, or another similar payment method). In this case, the legally binding agreement is concluded when you complete the ordering process, as described above, by pressing the "Buy" button.

(6) You can save your preferred payment method for future use. In this case, we will keep your payment credentials in accordance with the applicable standards in our industry (e.g., PCI DSS). You will be able to identify your stored card by its last four digits.

Coupons, Gift Cards and other Offers

We may from time to time offer coupons, gift cards or discounts and other offers (the "Offers") concerning our Products. These Offers are only valid for the duration that may be indicated therein. Offers cannot be transferred, modified, sold, exchanged, reproduced or distributed without our express written permission.

Refund or Exchange Policy

You have the right to withdraw without giving any reason within 14 days of receiving the product.

However, please note that the following products cannot be returned:

  • Damaged products
  • Products already worn

To exercise your right of withdrawal

  • You must notify us of your decision by email at contact@lacorneitalienne.com within the specified period.
  • We will acknowledge receipt of your withdrawal, and send you a confirmation and the procedure.

Return address

Return shipping costs are your responsibility. You must return the product(s) to us, carefully protected in their original packaging or a bubble envelope with postage. We require these precautions to avoid transport problems.

We reserve the right to refuse an exchange or refund if these conditions are not met. Please note that delays may occur during the holiday season.

Please note that once your request has been processed, we will contact you by email to notify you.

Refunds will be issued using the same payment method. Once the refund is processed, it will appear within 14 days.

Product Warranty

If a piece of jewellery is maintained and worn normally, it is rare for it to break. It is therefore necessary to distinguish between a manufacturing defect and misuse.

At La Corne Italienne, each piece of jewellery is carefully crafted with respect for the Italian tradition of the Cornicello, a symbol of protection and good luck.

La Corne Italienne offers a one-year commercial warranty from the date of purchase. This warranty only covers normal use of the product.

Excluded from the warranty are:

  • Damage related to an accident or misuse (Pressure, shock, crushing, exposure to corrosive substances, etc.)
  • Loss of the pendant
  • Theft or loss
  • Natural wear and tear and normal ageing of the jewellery
  • Link bracelets, which are not covered by this warranty

Any deterioration resulting from improper use may incur repair costs, depending on the nature of the damage. Please report any problem within 14 days of purchase.

In this case, an expert assessment will be carried out by the brand and will result in a quote to be paid by the customer. Generally, a repair fee of between €15 and €30 is applied.

To request an assessment, please follow these steps:

Email us a photo of the product concerned along with a description of the problem encountered.

1.        We will promptly inform you of the repair fee.

2.        If you accept the quote, you will receive a payment link. After payment, you must return the product(s), carefully protected in their original packaging, to the following address:

From the date of receipt of the product, the average processing time is approximately three weeks to receive your repaired jewellery.

1.        If the Product is affected by a hidden defect, you are entitled to act under the warranty provided by articles 1641 et seq. of the Civil Code for 1 year from the discovery of the defect. A hidden defect implies that it renders the Product unfit for its intended use, or that it hinders its use in such a way that you would not have purchased it or would have paid a lower price if you had been aware of the defect. This also implies that you did not know the defect existed when you purchased the Product.

2.        If the Product is affected by a hidden defect, you are entitled to act under the warranty provided by articles 1641 et seq. of the Civil Code for one year from the discovery of the defect. A hidden defect implies that it renders the Product unfit for its intended use, or that it hinders its use in such a way that you would not have purchased it or would have paid a lower price if you had been aware of the defect. This also implies that you did not know the defect existed when you purchased the Product.

3.        As a consumer, you benefit from the legal guarantee of conformity under the conditions of article L. 217-4 et seq. of the Consumer Code. The legal guarantee protects the consumer when purchasing a product that does not conform to its description, or that is not suitable for its normally intended use, due to defects in conformity at the time of delivery. You have one year from the delivery of a Product to act under the legal guarantee of conformity. You may request the repair or replacement of the Product, except within the framework of the provisions of article L. 217-9 paragraph 2 of the Consumer Code. If the repair or replacement of the Product is impossible, you may promptly return the Product to us to be entitled to a full refund. For the 24 months following delivery, you do not have to provide proof of the existence of the alleged defect.

4.        Except as expressly provided in these Terms and to the fullest extent permitted by applicable law, we disclaim all other warranties or conditions, whether oral or written, including, but not limited to, those concerning accuracy, timeliness, completeness, results, performance, freedom from error or interruption of performance, title, non-infringement, quality, quality of information, quiet enjoyment, merchantability or fitness for a particular purpose (even if we have been informed of such purpose), as well as all express or implied representations, warranties or other conditions arising from the course of performance, conduct of business or usage of trade.

Member account

(1) To access and use certain sections and features of our Site, you must first register and create an account ("Member Account"). You must provide accurate and complete information when creating your Member Account.

(2) If a person other than yourself accesses your Member Account and/or any of your settings, they will be able to perform all actions available to you, including making changes to your Member Account. Therefore, we strongly encourage you to keep your Member Account login credentials secure. All such activities may be considered as having occurred in your name and on your behalf, and you will be solely responsible for all activities that occur on your Member Account, whether you have specifically authorized them or not, and for all damages, expenses or losses that may result from such activities. You are responsible for activities carried out on your Member Account in the manner described if you have negligently allowed the use of your Member Account by failing to take reasonable care to protect your login credentials.

(3) You can create and access your Member Account through a dedicated web page or by using a third-party platform such as Facebook (the "Social Network Account"). If you register through a third-party platform account, you authorize us to access certain information about you that is stored in your Social Network Account.

(4) We may temporarily or permanently terminate or suspend your access to your Member Account without incurring any liability, in order to protect ourselves, our Site and our Services or to protect other users, including if you violate any provision of these Terms or any applicable law or regulation in connection with your use of the site or your Member Account. We may do so without prior notice if circumstances require immediate action; in this case, we will notify you as soon as reasonably possible. In addition, we reserve the right to terminate your Member Account without cause, by sending you two months' prior notice by email, if we discontinue our Member Account program or for any other reason. You can stop using your Member Account and request its deletion at any time by contacting us.

Intellectual Property

(1) Our Services and associated content (and any derivative works or enhancements thereof), including, but not limited to, all text, illustrations, files, images, software, scripts, graphics, photos, sounds, music, videos, information, content, materials, products, services, URLs, technologies, documentation, trademarks, service marks, trade names and trade dress and interactive features, as well as all intellectual property rights related thereto, are our property or licensed to us (collectively, "Our Intellectual Property"), and nothing herein grants you any right in relation to Our Intellectual Property. Unless expressly stated herein or required under mandatory provisions of applicable law for the use of the Services, you will not acquire any right, title or interest in Our Intellectual Property. All rights not expressly granted in these terms are expressly reserved.

(2) If the Products include digital content such as music or videos, the rights indicated for such content on the Site will be granted to you.

Disclaimer of Warranty for Use of the Site and Services

The Services, Our Intellectual Property and all documents, information and content provided in connection therewith that are made accessible to any user free of charge are provided "as is" and "as available", without any warranty of any kind, express or implied, including any warranty of fitness for a particular purpose and any warranty regarding the security, reliability, timeliness, accuracy or performance of our services, except in the event of malicious non-disclosure of defects. We do not warrant that our free Services will be provided without interruption or error, or that they will meet your needs. Access to the Services and the Site may be suspended or limited due to repairs, maintenance or updates. The warranty for Products you have purchased from us, as mentioned in the "Product Warranty" section above, will not be affected.

Indemnification

You agree to defend and indemnify us against any actual or alleged claim, damage, cost, liability and expense (including, but not limited to, reasonable attorneys' fees) arising from, or related to, your use of the Site and Services in violation of these Terms, including in particular any use that would violate the limitations and requirements set forth in these Terms, unless such circumstances are not caused by your fault.

Limitation of Liability

1.        To the fullest extent permitted by applicable law, we disclaim all liability for any amount or type of loss or damage that may result to you or a third party (including any direct or indirect loss and any loss of income, profits, goodwill, data, contracts, as well as any loss or damage resulting from, or related to, business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time, even if foreseeable, in connection with (i) this Site and its content, (ii) the use, inability to use or results of use of this site, (iii) any website linked to this Site or the materials on these linked websites.

2.        We shall not be liable for any delay or failure to perform our obligations arising from these Terms if such delay or failure results from a cause beyond our control and/or an event of force majeure within the meaning of article 1216 of the Civil Code.

Modification of Terms or Services; Interruption

(1) We reserve the right to modify these Terms whenever necessary, at our sole discretion. You should therefore review them regularly. If we make substantial changes to these Terms, we will inform you that substantial changes have been made. Your continued use of the Site or our Service after such a change will constitute your acceptance of the new Terms. If you do not accept any of these terms or any future version of the Terms, do not access or use the Site or Service.

(2) We may modify the Services, cease providing the Services or any feature of the Services we offer, or create limits for the Services. ·        Unless otherwise indicated, if any part of these Terms is deemed illegal or unenforceable for any reason, it is agreed that such part of these Terms will be deleted, and the remaining terms of these Terms will not be affected and will remain in force.

·        By accepting the Terms, you agree not to challenge the probative value of the documents exchanged via the Site, on the basis of their electronic nature. Computerized records are considered as proof of communications, orders and payments made between us.

(3) Your acceptance of the Terms constitutes an agreement on proof, within the meaning of article 1368 of the Civil Code.
